1.1 These terms and conditions apply to the sale of goods at www.northhantstyres.com and northhantstyre.co.uk
North Hants Tyres and Re-Moulding Limited at Henry John House, 2 Ivy Road,
Aldershot, Hampshire, GU12 4TX (the Seller). and relates to all
goods advertised on the web site
1.2 Buy clicking the "ACCEPT" button the buyer of the Seller's goods (the Buyer) is deemed to have accepted the terms and conditions contained herein by placing an order with the Seller either in writing, by e-mail or orally.
1.3 The Seller's failure to object to any term or condition contained in any communication, whether written, online or oral, from the Buyer, shall not be deemed a waiver of these terms and conditions.
2.1 Submitting a completed customer order form for a product does not
constitute a contract with the Seller.
2.2No contract will be created between the Buyer and the Seller for the sale of any product unless and until authorisation has been received by the Seller from the Buyer's credit card issuer for full payment for the goods to be supplied and until the Seller has accepted your order by e-mail.
2.3The Seller reserves the right to refuse to supply any ordered product or to cancel an order for any reason without liability of any kind save for the return of any payment that may have been made with respect to such product.
3.1 All goods ordered by 14.30 hours will be dispatched that working day.
not including Weekends or Public Holidays when goods will be sent out the next working day
3.2 Delivery time to the mainland UK is 1-2 working days, not including the following working day after a weekend or bank holiday.
3.3 Delivey next working day is Monday to Friday.
3.4 All goods shall be delivered to the "Delivery Address" appearing in the completed customer order form.
4. Terms of payment
All goods shall be paid for in full prior to dispatch, unless the Seller otherwise agrees in writing.
5. Value Added Tax
VAT will be charged on all sales in accordance with current legislation at the time of invoicing.
6. Distance Selling Regulations
You have a right to cancel your order within seven working days following the day
after the date of delivery for any unused item purchased through the
catalogue or web site under the distance selling regulations for
To cancel any item, you can e-mail, fax or write to us quoting your customer number and order number. You must take reasonable care of the items, retain all original packaging and must not use them. Goods must be returned to us within seven days of your notice to cancel. Items must be returned to our Mail Order Department. All goods are returned at your own expense unless the item is deemed faulty or incorrect, where we will refund the cost on receipt of the goods. Should you require your unwanted goods to be collected, we will deduct the appointed couriers direct costs from the refund given.
Providing the goods are received back in an unused condition and in their original packaging with all accessories, you will receive a refund within thirty days of your notice to cancel. For your security please return items recorded delivery with insurance paid as a minimum. This does not apply to any perishable goods, or item personalised or made to your specification.
Returns/lost goods/Right To Cancel
7.1Should a placed order be required to be ceased. Should the goods
not be already despatched then notify us and this will be cancelled
and a full refund made . Should the goods be a Special Order and en
route then the goods will have to be paid for and credited upon its
return less any handling / shipping costs incurred.
7.2 All refunds will be Credited back by the same methed which you have purchased the good by.
7.3 No goods may be returned without prior authorisation by the Seller.
7.4 Application for return of goods must be made to the Seller within seven (7) days from receipt of goods.
7.5 Unless the return charge is to be met by the Buyer, only our nominated carrier may be used to return goods.
7.6 Goods lost in transit: the Seller must be notified within seven (7) days of the non-arrival of goods. Failure to do so will result in an unacceptable claim.
7.7 Goods accepted for return as a result of the Buyer's error will attract the original delivery costs plus a 30per cent restocking fee and any return charges if applicable.
8. Title to goods
The Seller shall retain title to all goods supplied by it to the Buyer until it has received payment in full of all sums due in connection with the supply of all goods by the Seller to the Buyer at any time. In the case of payment by cheque, bill of exchange or note, title shall not pass to the Buyer until the same is honoured.
Save where the Seller can be shown to have failed to exercise reasonable care in the supply of then Goods and such failure results in the death or personal injury the Seller shall not be without prejudice be liable to the Buyer for loss injury or any damage of any kind whatsoever consequential which result directly or indirectly from the Seller’s supply or failure to supply Goods to the Buyer. By entering this site you agree that any loss of profits or damage to equipment or data which occurs directly or indirectly from use of this site will be your own responsibility and not that of the Seller.
10.1 All prices are quoted in Pounds Sterling (GBP).
10.2 Prices are subject to change without notice, except after an order has been placed and payment has been received.
10.3 All price are plus + V.A.T and Carriage
11 Sub Contractors
The Seller shall be entitled without the prior consent of the Buyer to subcontract the whole or any part of the contract or to employ any independent contractor to perform its obligations under the contract.
12 Force Majeure
In the event that the manufacture or delivery of any of the Goods is prevented or hindered directly or indirectly by fire, the elements, war, civil commotion, strikes or lockouts, industrial disputes, shortage of raw materials or fuel not withstanding that the Seller has taken all reasonable steps to procure the same, shortage of labour, break down or partial failure of plant and machinery, late receipt of the Buyers order or other necessary information acts, orders or regulations of Government, delay in any part of any independent subcontractors or supplier, or any other cause whatsoever beyond the reasonable control of the Seller then the time for the delivery of the Goods shall be extended for a reasonable period having regard to the effect to the delaying cause on the manufacture, delivery or performance.
The Seller does not sell products for purchase by person or persons under 17.
14 Refusal Of Transaction
We reserve the right to withdraw any Products from the Web Site at any time and/or remove or edit any materials or content on the Web Site. We may refuse to process a transaction for any reason or refuse service to anyone at any time in our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any Product from the Web Site whether or not that Product has been sold; removing, screening or editing any materials or content on the Web Site; refusing to process a transaction or unwinding or suspending any transaction after processing has began

arrangement thereof, all software compilations and all other
material on this web site are the copyright of the Seller or its
suppliers, content and technology providers.
15.2 Products, brand and company names mentioned on this site may be the trademarks or registered trademarks of their respective owners.
16. Data protection
The Buyer confirms that the Seller may store details of the Buyer's name, address and e-mail for the purposes of sending further information about the Seller's products and services. This information will not be passed on the any third party, and will only be use by North Hants Tyres.
17. User declaration
The Buyer warrants that it is authorised to use any credit card the details of which may be given to the Seller for the purpose of paying for the goods to be supplied and will indemnify the Seller against all losses costs claims damages and expenses it may suffer as a result of any breach by the Buyer of these terms and conditions.
18. Entire agreement
These terms and conditions constitute the entire agreement between the Seller and the Buyer.
19. Governing law
These terms and conditions are governed by and are to be construed in accordance with the laws of England and Wales. The Buyer agrees to submit to the non-exclusive jurisdiction of the English Courts in the event of any dispute arising out of or in connection with these terms and conditions.
